Data Protection Act 2018

1

Short title, citation and commencement

1. (1) This Act may be cited as the Data Protection Act 2018.

(2) This Act and the Data Protection Acts 1988 and 2003 may be cited together as the Data Protection Acts 1988 to 2018.

(3) This Act shall come into operation on such day or days as the Minister may by order or orders appoint either generally or with reference to any particular purpose or provision and different days may be so appointed for different purposes or different provisions, and for the repeal of different enactments or provisions of enactments effected by section 7.

Power pursuant to subs. (3) exercised (1.01.2020) by Data Protection Act 2018 (Commencement) (No. 2) Order 2019 (S.I. No. 570 of 2019).

2. The 1st day of January 2020 is appointed as the day on which the following provisions of the Data Protection Act 2018 (No. 7 of 2018) shall come into operation:

(a) section 25;

(b) section 176(b).

2. The 30th day of October 2019 is appointed as the day on which section 7(3), insofar as it relates to the revocation of the Data Protection Act 1988 (Section 5(1)(d)) (Specification) Regulations 1993 (S.I. No. 95 of 1993), insofar as those Regulations relate to the functions of the Central Bank of Ireland to which Regulation 3 of those Regulations applies, of the Data Protection Act 2018 (No. 7 of 2018) shall come into operation.

Power pursuant to subs. (3) exercised (24.05.2018 and 25.05.2018) by Data Protection Act 2018 (Commencement) Order 2018 (S.I. No. 174 of 2018).

2. The 24th day of May 2018 is appointed as the day on which sections 1and 9of the Data Protection Act 2018shall come into operation.

3. The 25th day of May 2018 is appointed as the day on which the Data Protection Act 2018 , other than—

(a) section 7(3) (insofar as it relates to the revocation of the Data Protection Act 1988 (Section 5(1)(d)) (Specification) Regulations 1993 ( S.I. No. 95 of 1993 ), insofar as those Regulations relate to the functions of the Central Bank of Ireland to which Regulation 3 of those Regulations applies),

(b) section 25,

(c) section 30, and

(d) section 176(b),

insofar as it is not already in operation, shall come into operation
