1

Short title, collective citation and commencement

1. (1) This Act may be cited as the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023.

(2) The Public Health (Tobacco) Acts 2002 to 2015 and this Act may be cited as the Public Health (Tobacco) Acts 2002 to 2023.

(3) This Act shall come into operation on such day or days as the Minister may appoint by order or orders either generally or with reference to any particular purpose or provision and different days may be so appointed for different purposes and different provisions.

2. The 2nd day of February 2026 is appointed as the day on which the following provisions of the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (No. 35 of 2023) shall come into operation:

(a) subsections (1)(a), (1)(b) and (2) of section 9;

(b) Part 2;

(c) section 25;

(d) section 27;

(e) section 32;

(f) section 34;

(g) section 39;

(h) subsections (c) and (e) of section 45.

Power pursuant to subs. (3) exercised (29.09.2025) by Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (Commencement) (No. 2) Order 2024 (S.I. No. 269 of 2024).

2. The 29th day of September 2025 is appointed as the day on which the following provisions of the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (No. 35 of 2023) shall come into operation:

(a) section 26;

(b) subsections (a) and (b) of section 45.

Power pursuant to subs. (3) exercised (29.03.2024, 23.09.2024) by Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (Commencement) Order 2024 (S.I. No. 121 of 2024.

3. The 29th day of March 2024 is appointed as the day on which section 33 of the Act of 2023 shall come into operation.

4. The 23rd day of September 2024 is appointed as the day on which sections 29, 30 and 31 of the Act of 2023 shall come into operation.

2. The 22nd day of December 2023 is appointed as the day on which the following provisions of the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 (No. 35 of 2023) come into operation:

(a) sections 1 to 8;

(b) section 9(1)(c);

(c) section 10;

(d) section 28;

(e) Part 5 (other than section 39);

(f) Part 6 (other than section 45);

(g) Part 7.
