Electoral Reform Act 2022

Short title, collective citations, construction and commencement

1. (1) This Act may be cited as the Electoral Reform Act 2022.

(2) The Electoral Acts 1992 to 2019 and sections 6 to 30 , 41 to 59, 61 to 69, 72, 77 to 114 and 173 may be cited together as the Electoral Acts 1992 to 2022 and shall be construed together as one.

(3) The European Parliament Elections Acts 1992 to 2019 and sections 75, 115 and 176 may be cited together as the European Parliament Elections Acts 1992 to 2022 and shall be construed together as one.

(4) The Referendum Acts 1992 to 2013 and sections 31 to 40, 117 and 174 may be cited together as the Referendum Acts 1992 to 2022 and shall be construed together as one.

(5) This Act shall come into operation on such day or days as the Minister may appoint by order or orders either generally or with reference to any particular purpose or provision and different days may be so appointed for different purposes or different provisions, and for the repeal of different provisions of enactments effected by section 4.

2. The 9th day of February 2023 is appointed as the day on which the following provisions of the Electoral Reform Act 2022 (No. 30 of 2022) shall come into operation:

(a) paragraphs (h) to (k) of subsection (1) of section 4 of Part 1;

(b) subsections (3) and (4) of section 4 of Part 1;

(c) Part 2 (insofar as it is not already in operation);

(d) section 98 of Chapter 1 of Part 3;

(e) Part 9.

2. The 1st day of January 2023 is appointed as the day on which the following provisions of the Electoral Reform Act 2022 (No. 30 of 2022) shall come into operation:

(a) section 7 of Chapter 2 of Part 2;

(b) sections 179, 180, 181, 184, 185, 186, 188, 190, 191, 194, 195, 196, 197, 198 and 199 (insofar as it relates to the insertion of section 91 into the Electoral Act 1997 (No. 25 of 1997)) of Part 7.

Power pursuant to subs. (5) exercised (13.10.2022) by Electoral Reform Act 2022 (Commencement) Order 2022 (S.I. No. 512 of 2022).

2. The 13th day of October 2022 is appointed as the day on which the following provisions of the Electoral Reform Act 2022 (No. 30 of 2022) shall come into operation:

(a) Part 1, other than –

(i) section 3,

(i) paragraphs (h) to (k) of subsection (1) of section 4, and

(i) paragraphs (h) to (k) of subsection (1) of section 4, and

(iii) subsections (3) and (4) of section 4;

(b) Chapter 1 of Part 2 and sections 9, 10, 11, 12, 19 and 21 of Chapter 3 of Part 2;

(c) Part 3 (other than section 98);

(d) Part 6;

(3) Part 8.
