Personal representatives and trustees
21. (1) In the performance in accordance with the law of administration of estates or trustees of functions as a personal representative or trustee, a personal representative or trustee shall not be required to enquire, before conveying or distributing any property, whether a gender recognition certificate has been issued to any person or revoked, if that issue or revocation could affect entitlement to the property.
(2) A personal representative or trustee shall not be liable to any person by reason of a conveyance or distribution of property, made without regard to whether a gender recognition certificate has been issued to any person or revoked, if the personal representative or trustee has not received notice of the issue or revocation before the conveyance or distribution.
(3) Nothing in this section shall affect the right of a person to make a claim in respect of any property, other than where the property is sold to a purchaser for value in good faith and without notice.
