Private Security Services Act 2004

Short title and commencement.

1.—(1) This Act may be cited as the Private Security Services Act 2004.

(2) This Act shall come into operation on such day or days as may be fixed by order or orders made by the Minister, either generally or by reference to any particular purpose or provision, and different days may be so fixed for different provisions and different purposes of this Act.

3. The 29th day of September 2023 is fixed as the day on which section 37 (amended by section 13 of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Principal Act comes into operation in respect of an individual -

(a) who provides a security service as a door supervisor, in so far as the said section 37 is not already in operation in respect of an individual who provides a security service as a door supervisor,

(b) who provides a security service as a private investigator, or

(c) who, as a security guard, provides the security services referred to in paragraph (e) of the definition of “security guard” in section 2(1) of the Principal Act.

2. The 1st day of June 2018 is fixed as the day on which section 37 (as amended by section 13 of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Private Security Services Act 2004 (No. 12 of 2004) comes into operation as respects a security guard (monitoring centre), who as a security guard monitors security equipment which consists of a continuously manned remote centre to which information concerning the status of one or more alarm or cctv systems is reported.

2. The 1st day of February 2017 is fixed as the day on which section 37 (as amended by section 13 of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Private Security Services Act 2004 (No. 12 of 2004) comes into operation as respects a private security employer or an independent contractor who provides a security service as a locksmith.

2. The 1st day of November 2015 is fixed as the day on which section 37 (as amended by section 13 of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Private Security Services Act 2004 (No. 12 of 2004) comes into operation as respects a private security employer or an independent contractor who provides a security service as a private investigator.

3. The 1st day of November 2014 is fixed as the day on which section 37 (as amended by section 13 of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Private Security Services Act 2004 (No. 12 of 2004) comes into operation as respects a private security employer or an independent contractor who provides a security service as a—

(a) security guard (alarm monitoring),

(b) security guard (cctv monitoring).

3. The 1st day of November, 2014 is fixed as the day on which section 37 (as amended by section 13 of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Private Security Services Act 2004 (No. 12 of 2004) comes into operation as respects a private security employer or an independent contractor who provides a security service as a —

(a) door supervisor (event security),

(b) security guard (event security).

3. The 1st day of October 2012 is fixed as the day on which section 37 (as amended by section 13 of the Civil Law (Miscellaneous Provisions) Act 2011 (No. 23 of 2011)) of the Private Security Services Act 2004 (No. 12 of 2004) comes into operation as respects a private security employer or an independent contractor who—

(a) installs, maintains, repairs or services access control security equipment,

(b) installs, maintains, repairs or services cctv security equipment,

(c) maintains, repairs or services intruder alarms.

Power pursuant to subs. (2) exercised (1.12.2008) by Private Security Services Act 2004 (Section 37) (Commencement) Order 2008 (S.I. No. 497 of 2008).

2. The 1st day of December 2008 is fixed as the day on which section 37 of the Private Security Services Act 2004 (No. 12 of 2004) comes into operation in so far as it refers to a provider of protected forms of transport referred to in paragraph (f) of the definition of “security service ” in section 2(1) of that Act.

Power pursuant to subs. (2) exercised (1.04.2007) by Private Security Services Act 2004 (Section 37) (Part) (Commencement) Order 2007 (S.I. No. 306 of 2007).

3. The 1st April 2007 is fixed as the day on which section 37 of the Act comes into operation for the purposes of its application in relation to a door supervisor (licensed premises) or security guard (static).

Power pursuant to subs. (2) exercised (1.08.2006) by Private Security Services Act 2004 (Section 37 (Part)) (Commencement) (No.2) Order 2006 (S.I. No. 436 of 2006).

2. The 1st day of August, 2006, is fixed as the day on which section 37 of the Act comes into operation for the purposes of its application in relation to an installer (intruder alarm), or a security guard (monitoring centre), within the meaning of the Private Security (Licensing and Standards) Regulations 2005 (S.I. No. 834 of 2005).

Power pursuant to subs. (2) exercised (1.04.2006) by Private Security Services Act 2004 (Sections 29 to 33, 35 and 37 (Part)) (Commencement) Order 2006 (S.I. No. 151 of 2006).

3. The 1st day of April, 2006, is fixed as the day on which -

(a) sections 29 to 33 and section 35 of the Act come into operation, and

(b) section 37 of the Act comes into operation for the purposes of its application in relation to a door supervisor (licensed premises), or a security guard (static), within the meaning of the Private Security (Licensing and Standards) Regulations 2005 (S.I. No. 834 of 2005).

Power pursuant to subs. (2) exercised (3.10.2005) by Private Security Services Act 2004 (Sections 13 to 16, 21 to 28, 34, 36 and 38, Parts 4, 5 and 7 and Schedule 2) (Commencement) Order 2005 (S.I. No. 637 of 2005).

2. The 3rd day of October 2005 is fixed as the day on which sections 13 to 16, 21 to 28, 34, 36 and 38, Parts 4, 5 and 7 and Schedule 2 of the Private Security Services Act 2004 (No. 12 of 2004) shall come into operation.

2. The 28th day of October 2004 is fixed as the day on which—

(a) Part 1,

(b) sections 6, 7, 8, 9, 10, 11, 12, 17, 18, 19 and 20, and

(c) Schedule 1. of the Private Security Services Act 2004 (No. 12 of 2004) shall come into operation.
