Saving for indictment for nuisance.
125.— Nothing in F255 [ the Road Traffic Acts, 1961 to 1994 ] shall authorise any person to use in a public place a vehicle so constructed or used as to cause a public or private nuisance, and any person who so uses such vehicle shall, notwithstanding anything in F255 [ the Road Traffic Acts, 1961 to 1994 ] , be liable to an indictment or action, as the case may be, for such use when, but for the passing of the repealed Act and F255 [ the Road Traffic Acts, 1961 to 1994 ] , such indictment or action could be maintained.
