F489[Power to remit matters to F490[Bank] for further consideration.

57X

57X.(1) At any stage of proceedings to determine an appeal against an appealable decision, the Appeals Tribunal may remit the decision to the F490[Bank] for its reconsideration.

(2) The F490[Bank] shall reconsider a decision remitted under subsection (1) and on the reconsideration may

(a) affirm the decision, or

(b) vary the decision, or

(c) substitute for the decision a new decision.

(3) If the F490[Bank] varies the remitted decision

(a) the appeal is taken to be an appeal against the decision as varied, and

(b) the appellant may either

(i) proceed with the appeal as varied, or

(ii) withdraw the appeal.

(4) If the F490[Bank] substitutes for the remitted decision a new decision in substitution for the decision set aside

(a) the appeal is taken to be an appeal against the new decision, and

(b) the appellant may either

(i) proceed with the appeal in relation to the new decision, or

(ii) withdraw the appeal.]
