Provisions consequent upon conferral of functions or transfer of assets and liabilities
33. (1) Anything commenced and not completed before the establishment day by or under the authority of any of the dissolved bodies may, in so far as it relates to a function conferred on the Ombudsman by this Act, be carried on or completed on or after that day by the Ombudsman.
(2) Every instrument made under enactment and every document (including any certificate) granted or made, by any of the dissolved bodies, if and in so far as it was operative immediately before the establishment day, shall have effect on and after that day as if it had been granted or made by the Office.
(3) References to any of the dissolved bodies in the memorandum of association or articles of association of any company relating to a function conferred on the Office by this Act shall, on and after the establishment day, be construed as references to the Office.
(4) All moneys, stocks, shares and securities transferred by section 30 that, immediately before the establishment day, were standing in the name of any of the dissolved bodies shall, on the request of the Office, be transferred to the Office in its own name.
(5) A certificate signed by the Minister that any property, right or liability has or has not vested in the Ombudsman under section 30 or 31 shall be sufficient evidence, unless the contrary is shown, of the fact so certified for all purposes.
(6) The Minister may from time to time advance to the Ombudsman, out of moneys provided by the Oireachtas, such sums as the Minister may determine for the purposes of the performance of the functions relating to superannuation conferred on the Financial Services Ombudsman Council by the Act of 1942.
