F32[34C.— Where defamation proceedings have been initiated against a defendant and he or she is of the view that they—

(a) have been initiated on account of his or her engagement in public participation, and

(b) fall within the scope of Article 2 of Directive (EU) 2024/1069,

the defendant shall so inform the court.]
