Health and Social Care Professionals Act 2005
Appeal to High Court from Council’s decision under section 43.
44.—F82[(1) A person may appeal to the Court against a decision made by the Council under section 42B(4)(a)(i), 42B(4)(b)(i) or (ii), or 43(3)(a).]
(2) The appeal must be brought within 30 days after the person receives notification of the decision from the Council.
(3) In an appeal under this section, the Court may consider any evidence adduced or argument made, whether or not adduced or made to the Council.
(4) On the hearing of the appeal, the Court may make any order or give any direction it considers appropriate, including an order—
(a) confirming the decision under appeal, or
(b) modifying or overturning that decision.
F83[(5) A decision of the Court on an appeal against a direction made by the Council on an application under section 42B(2A) shall be final and conclusive.]
