F148[(2) A person shall not be surrendered under this Act where he or she has, in accordance with the law of the State, become immune, by virtue of any amnesty or pardon, from prosecution or punishment in the State for the offence specified in the relevant arrest warrant issued in respect of him or her, where that offence is one that the State has jurisdiction to prosecute under its own law.]
