(a) the care of one or more children undertaken by a relative of the child or children or the spouse of such relative,

F431[(2) Notwithstanding paragraph (a) of subsection (1), an application under section 58D(2) to be registered in the register may be made by—

(a) a relative to whom that paragraph applies, other than a parent of the child, or

(b) the spouse of such relative, other than where the relative is a parent of the child.

(3) In this section, "parent" includes a person acting in loco parentis.]
