F15[1B.In the Foreshore Acts 1933 to 2011 "appropriate Minister" means

(a) in relation to a fishery harbour centre, the Minister for Agriculture, Fisheries and Food,

(b) in relation to a function in respect of

(i) an activity which is wholly or primarily for the use, development or support of aquaculture, or

(ii) an activity which is wholly or primarily for the use, development or support of sea-fishing including the processing and sale of sea-fish and manufacture of products derived from sea-fish,

the Minister for Agriculture, Fisheries and Food,

(c) in relation to any other function exercisable under the Foreshore Acts 1933 to 2011, the Minister for the Environment, Community and Local Government.]]

Functions under para. (c) transferred and references construed (14.05.2024) by Foreshore (Transfer of Departmental Administration and Ministerial Functions) Order 2024 (S.I No. 236 of 2024), arts. 2, 3(1)(a), (2), in effect as per art. 1(2), subject to transitional provisions in arts. 4-8.

2. (1) The administration and business in connection with the exercise, performance or execution of any functions transferred by Article 3 are transferred to the Department of the Environment, Climate and Communications.

(2) References to the Department of Housing, Local Government and Heritage contained in any Act or any instrument made under an Act and relating to any administration and business transferred by paragraph (1) shall, from the commencement of this Order, be construed as references to the Department of the Environment, Climate and Communications.

3. (1) The functions vested in the Minister for Housing, Local Government and Heritage by or under the provisions of the –

(a) Foreshore Act 1933 (No. 12 of 1933) in so far as the functions relate only to the functions of the appropriate Minister referred to in section 1B (c) of that Act,

(b) Foreshore (Amendment) Act 1992 (No. 17 of 1992), and

(c) Fisheries (Amendment) Act 2003 (No. 21 of 2003), are transferred to the Minister for the Environment, Climate and Communications.

(2) References to the Minister for Housing, Local Government and Heritage contained in any Act or instrument made under such Act and relating to any functions transferred by this Article shall, from the commencement of this Order, be construed as references to the Minister for the Environment, Climate and Communications.
