27.— (1) Subject to subsection (2), a person to whom any power, whether coupled with an interest or not, is given F1[may release or contract not to exercise the power by deed or in any other way in which the power can be released] .

(2) Subsection (1) does not apply to a power in the nature of a trust or other fiduciary power.
