NATIONAL TRAINING FUND ACT 2000

This Revised Act is an administrative consolidation of the National Training Fund Act 2000. It is prepared by the Law Reform Commission in accordance with its function under the Law Reform Commission Act 1975 (3/1975) to keep the law under review and to undertake revision and consolidation of statute law.

All Acts up to and including Finance Act 2017 (41/2017), enacted 25 December 2017, and all statutory instruments up to and including Legal Metrology (Measuring Instruments) Act 2017 (Commencement) Order 2018 (S.I. No. 1 of 2018), made 4 January 2018, were considered in the preparation of this Revised Act.

AN ACT TO PROVIDE FOR THE IMPOSITION OF A LEVY ON EMPLOYERS, IN RESPECT OF CERTAIN EMPLOYEES, TO BE KNOWN AS THE NATIONAL TRAINING FUND LEVY, TO BE USED TO GIVE SKILLS TO, OR RAISE SKILLS AMONGST THOSE IN, OR SEEKING, EMPLOYMENT, TO PROVIDE FOR THE ESTABLISHMENT OF A FUND IN RESPECT OF THAT LEVY AND THE MANNER IN WHICH THAT FUND SHALL BE ADMINISTERED, TO PROVIDE FOR THE REPEAL OF THE INDUSTRIAL TRAINING (APPRENTICESHIP LEVY) ACT, 1994, AND CERTAIN SECTIONS OF THE INDUSTRIAL TRAINING ACT, 1967, AND TO PROVIDE FOR RELATED MATTERS. BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:

Name of Department and Minister changed from Education and Science to Education and Skills (2.05.2010) by Education and Science (Alteration of Name of Department and Title of Minister) Order 2010 (S.I. No. 184 of 2010), arts. 2-4.

2. The name of the Department of State, the present name of which is, in the Irish language, An Roinn Oideachais agus Eolaíochta and, in the English language, the Department of Education and Science, is altered, in the Irish language, to that of An Roinn Oideachais agus Scileanna and, in the English language, to that of the Department of Education and Skills.

3. The title of the Minister having charge of the Department of State, whose present title is, in the Irish language, an tAire Oideachais agus Eolaíochta and, in the English language, Minister for Education and Science, is altered, in the Irish language, to that of an tAire Oideachais agus Scileanna and, in the English language, to that of the Minister for Education and Skills.

4. In an enactment or instrument made under an enactment—

(a) references to the Department of Education and Science shall be construed as references to the Department of Education and Skills, and

(b) references to the Minister for Education and Science shall be construed as references to the Minister for Education and Skills.

Functions transferred (1.05.2010) by Employment Programmes and Services and Skills Training (Transfer of Departmental Administration and Ministerial Functions) Order 2010 (S.I. No. 187 of 2010), arts. 2, 3 subject to transitional provisions in arts. 4-8.

2. (1) The administration and business in connection with the exercise, performance or execution of any functions transferred by Article 3 are transferred to the Department of Education and Science.

(2) References to the Department of Enterprise, Trade and Employment contained in any Act or instrument made under such Act and relating to any administration and business transferred by paragraph (1) shall, from the commencement of this Order, be read as references to the Department of Education and Science.

3. (1) The functions vested in the Minister for Enterprise, Trade and Employment by or under— ...

(d) the National Training Fund Act 2000 (No. 41 of 2000), and

are transferred to the Minister for Education and Science.

(2) References to the Minister for Enterprise, Trade and Employment contained in any Act or instrument made under such Act and relating to any functions transferred by paragraph (1) shall, from the commencement of this Order, be read as references to the Minister for Education and Science.
