F87[Holders of licences etc. to keep certain records.

17

17.—(1) The holder of a licence F88[or authorisation under section 9A] and each related body shall—

(a) keep at an office or offices within the State such records as may be specified from time to time by the Bank, in the due discharge by the Bank of its functions, and

(b) notify the Bank in writing of the address of the office or offices where those records are kepart

Different kinds of records may be specified under this subsection for different licence holders F88[or holders of authorisations under section 9A] and related bodies.

(2) The requirement imposed by subsection (1) is additional to any other requirement imposed by law with respect to the keeping of records by the holder of a licence F88[or authorisation under section 9A] and by related bodies.

(3) The holder of a licence F88[or authorisation under section 9A] and each related body shall keep the records referred to in subsection (1) for such period as the Bank notifies in writing to that holder.

(4) The holder of a licence F88[or authorisation under section 9A] may keep its documents wholly or partly in a non-legible form so long as they are capable of being reproduced in a legible form.

Application of section 17 of Act of 1971

11.—Without prejudice to the provisions of section 9, section 17 (which relates to books and records of holders of licences) (as amended by section 36 of the Act of 1989) of the Act of 1971 shall apply as if—

(a) every payment system to which this Part applies, and

(b) every member of that system,

who is not at the time of the commencement of this section the holder of a licence for the purpose of the Central Bank Acts, 1942 to 1989, and this Act, were the holder of such a licence.

Application of section 17 of Act of 1971 to bureaux de change.

31.—Without prejudice to section 30 of this Act, section 17 of the Act of 1971 shall apply as if every person authorised by the Bank to carry on bureau de change business were the holder of a licence for the purposes of the Central Bank Acts, 1942 to 1997.

Application of sections 17 and 18 of Act of 1971

93.—Without prejudice to the provisions of section 92, the provisions of section 17 (which relates to books and records of holders of licences) and section 18 (which relates to furnishing of information to the Bank) of the Act of 1971 (as amended by this Part) shall apply to every financial institution to which this Chapter relates and to every associated enterprise (within the meaning of those sections) of such an institution as if each such institution were the holder of a licence for the purposes of the Central Bank Acts, 1942 to 1989.

Application of section 17 of Act of 1971

103.—Without prejudice to the provisions of section 101 the provisions of section 17 (which relate to books and records of holders of licences) of the Act of 1971 (as amended by this Part) shall apply as if every exchange to which this Chapter applies and every member of that exchange were the holder of a licence for the purpose of the Central Bank Acts, 1942 to 1989.

Application of section 17 of Act of 1971

112.—Without prejudice to the provisions of section 111, the provisions of section 17 (which relates to books and records of holders of licences) of the Act of 1971 (as amended by this Part) shall apply as if every person authorised by the Bank to carry on moneybroking business were the holder of a licence for the purposes of the Central Bank Acts, 1942 to 1989.
