55.The Board shall not without previous consultation with the Minister place or authorise any authorised undertaker to place any electric cable across any navigable river or navigable waterway, whether such cable is placed above or below water or under the ground.

However, functions transferred and Minister for Communications construed as Minister for the Marine in relation to this section (31.03.1987) by Communications (Transfer of Departmental Administration and Ministerial Functions) Order 1987 (S.I. No. 91 of 1987), arts. 3, 4(1)(c), (2) and sch. part IV, subject to transitional provisions in arts. 5-9. Note that the name of the Minister was changed to Marine and Natural Resources (12.07.1997) by Communications (Transfer of Departmental Administration and Ministerial Functions) Order 1987 (S.I. No. 301 of 1997), thereby returning s. 55 to the responsibility of the Minister as defined in s. 1.

4. (1) The functions vested in the Minister for Communications— ...

(c) by or under any of the Statutes mentioned in the third column of Part IV of the Schedule to this Order at any reference number of any statute mentioned in the second column of that Part of that Schedule at that reference number

are hereby transferred to the Minister for the Marine.

(2) References to the Minister for Communications contained in any Act or instrument made thereunder and relating to any functions transferred by this Article shall, on and after the commencement of this Order, be construed as references to the Minister for the Marine.

Note: It appears that the effect of Energy (Transfer of Departmental Administration and Ministerial Functions) Order 1977 (S.I. No. 295 of 1977), art. 4(3) and sch. 1 part 1 may have been overlooked by the drafter of the above S.I. No. 91 of 1987. This would have resulted in an assumption that the Minister for Transport and Power was construed as the Minister for Tourism and Transport (23.09.1977) by Transport and Power (Alteration of Name of Department and Title of Minister) Order 1977 (S.I. No. 305 of 1977), art. 4, in effect as per art. 1(2), further construed as a reference to the Minister for Transport (25.01.1980) by Tourism and Transport (Alteration of Name of Department and Title of Minister) Order 1980 (S.I. No. 11 of 1980), arts. 3, 4, in effect as per art. 1(2), and then construed as a reference to the Minister for Communications (2.01.1984) by Ministers and Secretaries (Amendment) Act 1983 (40/1983), s. 5(2), commenced as per s. 1 and Postal and Telecommunications Services Act 1983 (24/ 1983), s. 9(2), S.I. Nos. 407, 408 of 1983.
